Government to extend recognition of CE marking for goods placed on the market in Great Britain indefinitely.

The Department for Business and Trade (DBT) announced on the 1st August its intention to indefinitely extend the use of CE marking for businesses for the 18 regulations where they have jurisdiction. However, this change will not presently apply to other sectors such as construction products beyond 2025 as they are controlled by the Department for Levelling Up, Housing and Communities (DLUHC). An announcement on construction products and a potential CE mark extension is expected later this year.Following Brexit, the UKCA mark was intended to be a UK specific quality mark which was mandatory on all goods sold in the UK from 2022. This requirement was delayed until 2025 following concerns about testing capacity within the UK to obtain the right approvals in time.Following extensive engagement with industry, British firms will be able to continue the use of CE marking alongside UKCA to prevent a cliff-edge moment in December 2024 when UKCA was set for entry.Government communication - DBT (1st August)The government intends to extend recognition of the CE marking for placing most goods on the market in Great Britain, indefinitely, beyond December 2024. These updates apply to the 18 regulations that fall under the Department for Business and Trade (DBT). These are:

  • toys
  • pyrotechnics
  • recreational craft and personal watercraft
  • simple pressure vessels
  • electromagnetic compatibility
  • non-automatic weighing instruments
  • measuring instruments
  • measuring container bottles
  • lifts
  • equipment for potentially explosive atmospheres (ATEX)
  • radio equipment
  • pressure equipment
  • personal protective equipment (PPE)
  • gas appliances
  • machinery
  • equipment for use outdoors
  • aerosols
  • low voltage electrical equipment

READ GOVERNMENT ANNOUNCEMENT Construction ProductsThe government has not confirmed if a similar decision will be taken by the Department for Levelling Up, Housing and Communities (DLUHC) to allow for the CE Mark to be used beyond this date to show a product complies with national safety standards.Currently the DBT decision will not apply to construction products and goods used in the building engineering sector. These goods are still required to need to carry a valid UKCA mark from June 30, 2025. Products with no updated CE mark status announcement (correct at 24th August 2023)Some products are still covered by the UKCA marking regulations. Please consult the sector specific guidance for more information. They are:

 Will Jones, Chief Operating Officer of BHETA said: "This is excellent news for some UK businesses, particularly our members selling small electricals products, providing greater certainty over the regulations which had changed following the implementation of Brexit. They can now cut back on unnecessary development costs of a new standard and instead focus on product development, innovation and business growth. However, BHETA believes the current unequal position between product categories is untenable and we will be writing to the DLUHC in the strongest possible terms to encourage a level position across Government departments, particularly in relation to construction products."

Stuart McKay, Chair of BHETA's Environmental, Operations and Safety Committee (EOSC) said: "This is a pragmatic decision that manufacturers of Small Electrical Accessories will welcome. It gives us certainty to focus on product innovation rather than extra testing and new labels."
